Issue : Pro bono legal assistance was sought by the defendant seeking a Court order under r7.36 Uniform Civil Procedure Rules 2005(NSW) to be referred to the Registrar for referral to a barrister or solicitor on a

Pro Bono basis.

Held: given the proceedings’ nature and complexity the Court is satisfied it was in interests of the administration of justice that defendant have legal assistance.  However the defendant had not given adequate evidence of his assets and liabilities and even the defendant had not shown he could not obtain legal representation himself, the Court was not satisfied it was in interests of administration of justice to refer defendant to Registrar for referral to a barrister or solicitor on Pro Bono Panel and the notice of motion was dismissed.
